A Brief Introduction to Legal Theory in China

Legal Theory In China is a new electronic journal and is edited by the Ji Men Jurisprudence Workshop, an autonomous and academic association of China University of Political Science and Law in Beijing, China.

Legal Theory In China concentrates on the latest research in Anglo-American legal philosophy, aiming to build a communication platform for Chinese researchers and students in the field.

The journal was established by undergraduates and graduates who are interested in legal philosophy and is supported by three professors – Fan Libo, Chen Jinghui and LiuYeshen – who serve as the journal’s academic advisors. The journal is composed of six parts: Interviews, Symposium, Reviews, Translations, Prefaces and Postscripts of Books, and Latest Academic Information. The opening volume of Legal Theory In China was published on May 16th, 2011.

Interviews, Symposium and Reviews are the basic sections of this journal. The present volume opens with interviews with Professors Scott Shapiro and Brian Bix. The interview with Professor Shapiro focuses on the basic themes of his new book, Legality, and some fundamental problems of legal philosophy. Professor Shapiro discusses his Planning Theory of Law and responds to a number of criticisms. He also offers some suggestions to Chinese researchers on how to approach legal philosophy. In the next interview, Professor Bix discusses the state of the art in legal philosophy, and perspectives on its future. Professor Bix also outlines the core issues of legal philosophy and shares some of his own experience on research.

Upon the occasion of the fiftieth anniversary of the publication of Hart’s classic book The Concept of Law, we chose the Legal Philosophy of H.L.A. Hart as our Symposium topic. We wished to commemorate Hart, the greatest philosopher of law in the twentieth century, and his monumental contributions to the philosophy of law. Consequently, we have a conversation with Professors C.L.Ten and Wil Waluchow concerning their appraisal of Hart and his legacy.

NB: Though most of the journal is in Chinese, the interviews with Scott Shapiro, Brian Bix, C.L. Ten and Wil Waluchow appear in the original English. The English versions appear on pages 17-31, 36-39, and 63-65.
